With distillate, the decisive question cannot be sidestepped, because the product itself is the substance — with no carrier material, with no presentation that could distract from it.

What applies in Germany

HHC is listed by name in Anlage II to the Betäubungsmittelgesetz. Handling it — and that includes purchasing, storage and resale — requires a licence under § 3 BtMG. Anyone trading without one is operating within criminal law, not within the law on regulatory offences.

The entry provides for an exemption: for a non-synthetic form that is on the market for non-medical purposes. In practice, this exemption does not carry the trade. Commercially available HHC is created by hydrogenation from CBD or THC — which is precisely why it is not non-synthetic. Anyone wishing to invoke the exemption must be able to document the origin without any gaps; for hydrogenated goods, in our assessment, this proof cannot be furnished.

For wholesale, this simply means: no HHC without a § 3 licence. A batch with a clean certificate of analysis changes nothing about that, because the certificate documents the content and not the licence.

What “semi-synthetic” means in purchasing

HHC is created by hydrogenation: CBD or THC becomes a saturated molecule through the addition of hydrogen. It is precisely this step that rules out the exemption for non-synthetic forms. A supplier invoking it would have to demonstrate that its material was not created along this route — and in documented form across the entire chain, not as an assurance in the quotation.

This is not a formal objection. It is the only point at which the question can be decided at all.
