HHC flowers in wholesale: legal situation and alternatives
HHC flowers are sprayed CBD flowers. Why that changes nothing in legal terms and what traders buy instead.

As a rule, HHC flowers are not a plant of their own but CBD flowers that have been sprayed or wetted with an HHC distillate. That is decisive for the legal classification: what counts is the substance applied, not the carrier material.
What applies in Germany
HHC is listed by name in Anlage II zum Betäubungsmittelgesetz. Handling it — and that includes purchasing, storage and resale — requires a licence under § 3 BtMG. Anyone who trades without one is operating in criminal law, not in administrative-offence law.
The entry does provide for an exception: for a non-synthetic form that is on the market for non-medical purposes. In practice this exception does not support trade. Commercially available HHC is produced by hydrogenation from CBD or THC — it is therefore precisely not non-synthetic. Anyone wishing to rely on the exception must be able to document the origin without gaps; for hydrogenated goods this proof cannot, in our assessment, be furnished.
For wholesale this simply means: no HHC without a § 3 licence. A batch with a clean certificate of analysis does not change that, because the certificate documents the content and not the licence.
The point that is often overlooked in purchasing
Because the flower itself is inconspicuous, the goods are occasionally offered as a “CBD flower with an additive”. This description changes nothing about the classification. Conversely: a pure CBD flower remains a pure CBD flower — the difference lies solely in what has been applied, and it appears in the certificate of analysis.

How do I tell whether a flower has been treated?
From the certificate of analysis for the batch. It lists the cannabinoids contained individually. If the COA is missing, the question cannot be answered — and that alone is already a reason not to take the batch.
Why this article no longer says what it once said
