HHC Vapes in Wholesale: Two Sets of Rules, One Outcome

Vapes are the area in which two sets of rules overlap — and in which, most frequently, only one of them is checked.

What applies in Germany

HHC is listed by name in Annex II to the Betäubungsmittelgesetz. Handling it — and that includes purchase, storage and resale — requires a licence under § 3 BtMG. Anyone trading without one is operating in criminal law, not in the law on regulatory offences.

The entry does include one exception: for a non-synthetic form that is on the market for non-medical purposes. In practice, this exception does not carry the trade. Commercially available HHC is created by hydrogenation from CBD or THC — which means it is precisely not non-synthetic. Anyone wishing to rely on the exception must be able to document the origin without any gaps; for hydrogenated goods, in our assessment, this proof cannot be furnished.

For wholesale, this simply means: no HHC without a § 3 licence. A batch with a clean certificate of analysis does not change that, because the certificate documents the content and not the licence.

The second axis: product law

Alongside the question of whether a substance is marketable stands the question of how the finished product may be distributed and advertised. For electronic cigarettes and refill containers, the Tabakerzeugnisgesetz applies, with its own notification, labelling and advertising rules.

These two axes are independent of each other. A product can be presented in a way that is clean under product law and still contain a substance that is not marketable. The presentation says nothing about marketability — that is the mistake which becomes most expensive with vapes.

The notification concerns the presentation, not the ingredient. HHC is listed in Annex II to the BtMG; without a licence under § 3 BtMG, handling it is not permitted, irrespective of the notification.

Does this also apply to empty cartridges and batteries?

Accessories without an active substance are not affected by this. What is decisive is what is filled in.

Why this article no longer says what it once said
