HHC Vape Wholesale: What Traders Now Do With Remaining Stock

This page answers the questions that become practical after the change in the law — not the question of whether HHC is prohibited, but the question of what happens to what is still in the warehouse.

What applies in Germany

HHC is listed by name in Annex II to the Betäubungsmittelgesetz. Handling it — and that includes purchase, storage and resale — requires a licence under § 3 BtMG. Anyone trading without one is operating in criminal law, not in the law on regulatory offences.

The entry does include one exception: for a non-synthetic form that is on the market for non-medical purposes. In practice, this exception does not carry the trade. Commercially available HHC is created by hydrogenation from CBD or THC — which means it is precisely not non-synthetic. Anyone wishing to rely on the exception must be able to document the origin without any gaps; for hydrogenated goods, in our assessment, this proof cannot be furnished.

For wholesale, this simply means: no HHC without a § 3 licence. A batch with a clean certificate of analysis does not change that, because the certificate documents the content and not the licence.

Three practical points

• Selling off the stock is not a transitional solution. There is no grandfathering for goods that were purchased before a change in the law. A sale after the cut-off date is the same act as the sale of goods purchased after it.
• Ask your supplier in writing. Information on the production route — hydrogenated from CBD or not — belongs in the file, not in a telephone call. You need it when somebody asks.
• Check the catalogue, not just the warehouse. Experience shows that product pages, price lists and blog texts survive a clean-up of the range. This page here was exactly such a case.

What we stock instead

When switching, it is worth looking at the hardware: a large part of repeat purchases depends on draw behaviour and leak-tightness, not on the abbreviation of the active substance.
